Overview

This edited volume gathers original work by legal scholars and social scientists on how employment discrimination law operates as a social system. The chapters cross disciplinary lines to examine the gap between legal rights and lived realities โ€” how claims are made, contested, and resolved, and what the law actually achieves. The collection grew out of a 2003 conference at Stanford Law School sponsored by the American Bar Foundation. It anchors the research program on discrimination law and litigation that Nelson and Nielsen developed in later work, including Rights on Trial.

Originated in an American Bar Foundation / Stanford Law School conference (2003); a precursor to Rights on Trial (2017).
